Ruling on aborting the fetus if its age is less than forty days

Machine translationRead the Arabic original
Question:
A similar case, Your Eminence, the person asking says: My wife became pregnant three months and twenty days after giving birth to her child, and she was very distressed by that pregnancy. She was examined medically, and the doctors indicated that the fetus is approximately twenty days old. She asks Your Eminence: Is it permissible for her to dispose of that fetus so that she can raise this child whom she was very happy about, especially since he was preceded only by daughters?

Answer:
It is better not to proceed with aborting it; because Allah (Mighty and Majestic) may place much good in it; and because the Messenger (peace and blessings be upon him) encouraged increasing offspring, and he (peace and blessings be upon him) said:
Marry women who are fertile and loving, for I will be boasting with you before the nations on the Day of Resurrection.تزوجوا الولود الودود فإني مكاثر بكم الأمم يوم القيامة
Sunan al-Bayhaqi 10:869
, so seeking reward in increasing children is a desirable matter, especially since she does not have more than one child, and she does not have an illness, so what is better and more preferable for her is not to proceed with aborting it. If she aborts it within the forty days for a benefit she sees and her husband agrees to it, there is no blame on her, but the better and more preferable thing is to leave it, due to the great benefit mentioned earlier, and realizing what the Prophet (peace and blessings be upon him) said. But as long as the fetus is within the forty days, and has not exceeded the forty days, the matter is easier and more lenient, and leaving it un-aborted is better.

The presenter: May Allah reward you with good. Your Eminence says: He has two daughters who preceded this child, so he has three children...?

The Shaykh: There is no blame, if there is hardship in it, there is no blame, and this is a matter of regulation, especially within the forty days, the matter is easier. Yes.

The presenter: May Allah reward you with good. But you advise patience, perhaps Allah...?

The Shaykh: Whenever patience is possible, it is better .... And we ask Allah to help her.

The presenter: O Allah, amen, may Allah reward you with good.
