Q: We present to your Excellency the complete medical record of the pregnant woman (M. A.) who is in her nineteenth week or beyond. The ultrasound revealed a deficiency in the growth of the upper part of the fetus's head. You will find the medical reports attached, which indicate that continuing this pregnancy will lead to complications for the mother, and that the hope for life in such cases after birth is weak, as confirmed by the treating physician. And Allah knows best. Request: We hope your Excellency will graciously review this and provide guidance on what you deem appropriate from a Sharia perspective. May Allah reward you and benefit us with your knowledge.
A: It is not permissible to abort the fetus after this period due to the deformity or deficiency mentioned by the doctors. Rather, the matter is left to Allah (Glorified and Exalted is He), and Allah (Glorified and Exalted is He) is capable of completing it in its final stages. The doctors' opinions may be wrong or right, so they should not be relied upon in such a serious matter. Since the decision of the Council of Senior Scholars, number (140), dated 20/6/1407 AH, was issued, which stipulated that it is not permissible to abort the pregnancy after the third stage or after completing
four months of pregnancy, unless a group of trusted, specialized doctors determines that keeping the fetus in the mother's womb will cause her death, and this is after exhausting all means to save its life. The permission to proceed with abortion under these conditions is granted to avert the greater of two harms and to secure the greater of two benefits.
