Question:
A message was received for the program from Iraq, sent by our brother Muhammad Husayn 'Ali Hamuri or Hamuri. Our brother has a set of questions. In his first question, he asks about the exegesis of the saying of Allah the Exalted, after seeking refuge in Allah from the accursed Shaytan:
Is there in that an oath for one of understanding?هَلْ فِي ذَلِكَ قَسَمٌ لِذِي حِجْرٍ
[Al-Fajr:5]?

Answer:
Al-Hijr: it is the intellect. And Allah says, Exalted is He:
(1) By the dawn (2) And [by] ten nights (3) And [by] the even [number] and the odd (4) And [by] the night when it passes, (5) Is there [not] in [all] that an oath [sufficient] for one of perception?وَالْفَجْرِ ۝ وَلَيَالٍ عَشْرٍ ۝ وَالشَّفْعِ وَالْوَتْرِ ۝ وَاللَّيْلِ إِذَا يَسْرِ ۝ هَلْ فِي ذَلِكَ قَسَمٌ لِذِي حِجْرٍ
[Al-Fajr:1-5].
This verse clarifies that these oaths are great. Allah, Exalted is He, swore by them. He, (Exalted and Majestic is He), swears by whatever He wills ; no one can hinder Him . He only swore by them because they are among His signs indicating His great power and that He is the Lord of the worlds. So He said:
And the dawnوَالْفَجْرِ
[Al-Fajr:1], which is the splitting of the dawn after the departure of the night.
and ten nightsوَلَيَالٍ عَشْرٍ
[Al-Fajr:2], so these nights are the nights of the ten days of Dhul-Hijjah and the nights of the last ten days of Ramadan, and they are all magnified.
and the even and the oddوَالشَّفْعِ وَالْوَتْرِ
[Al-Fajr:3],
The evenالشفع
the two, the four, the six, and the like,
and the oddوالوتر
the one, the three, the five, and the like, are all among the signs of Allah . He made them even and odd in His creation, (Exalted and Majestic is He), and they are among His signs . The heavens are seven, which is odd, and the earth is seven, which is odd, and the Throne is one, which is odd, and the Footstool is one, which is odd. And He made things even, such as the night and the day being even, and the male and the female being even, and others, as He, Exalted is He, said:
And of all things We created two matesوَمِنْ كُلِّ شَيْءٍ خَلَقْنَا زَوْجَيْنِ
[Adh-Dhariyat:49].
And [by] the night when it passes,وَاللَّيْلِ إِذَا يَسْرِ
[Al-Fajr:4], likewise, among His signs is this night when it comes with its darkness, and the day when it comes with its light; all of these are among His signs .
Then He said after that:
Is there in that an oath for one of understanding?هَلْ فِي ذَلِكَ قَسَمٌ لِذِي حِجْرٍ
It does not imply that one should contradict, but rather it is obligatory for the believer to reflect, use his intellect, and know that He, Exalted is He, only swore by these oaths to indicate to His servants the greatness of these creations and that they are among the proofs of His great power and His oneness , and that it is not permissible for the believer to contradict what they indicate, by associating partners with Allah and worshipping others alongside Him, while He is the Creator of these things and the Provider of the sustenance of the servants, among other things .
Another possible meaning is that He, Exalted is He, intends
Is there in that an oath for one of understanding?هَلْ فِي ذَلِكَ قَسَمٌ لِذِي حِجْرٍ
[Al-Fajr:5], to swear by Him, which is more worthy than these oaths that contain proofs of His great power, even though He, Exalted and Majestic is He, has forbidden swearing by other than Him. The Prophet (peace and blessings be upon him) said:
Whoever has to take an oath should swear by Allah or remain silent.من كان حالفًا فليحلف بالله أو ليصمت

So no one has the right to swear except by his Lord (peace and blessings be upon him).
The verse contains some ambiguity, but it is possible that the intended meaning is that this oath is sufficient to indicate the greatness of these creations and that they are among the proofs of His great power. It is also possible that the meaning is: Is there in that, for one of understanding, another oath by which one should swear to indicate the oneness of Allah, the call to His worship, and sincerity to Him ? This—Allah knows best—is among the meanings. Another meaning is possible, and perhaps we will return to that in another session to increase the explanation and clarification of what the scholars said.
