Question:
If I arrive while the imam is at the end of the prayer, just before the taslim, and I have a group with me, do we join the imam, or do we pray as a congregation by ourselves? And what is the evidence that the takbir of ihram suffices for the takbir of ruku' if one joins the imam while he is in ruku'?

Answer:
What the questioner said has some leeway—Allah willing—but the apparent meaning of the hadiths is that he joins the imam; because the Prophet (peace and blessings be upon him) said:
and pray whatever you get (with the people) and complete the rest which you have missedما أدركتم فصلوا، وما فاتكم فأتموا
Sahih al-Bukhari 635
And in another wording:
So make up what you missedفاقضوا
.
So the one who arrives before the imam says the taslim has caught up with part of the prayer, and his case is covered by his saying:
So whatever you catch up with, prayفما أدركتم فصلوا
He (peace and blessings be upon him) said:
When you hear the iqamah, walk with calmness and composure. Whatever you catch up with, pray it, and whatever you miss, complete it.إذا سمعتم الإقامة فامشوا وعليكم السكينة والوقار، فما أدركتم فصلوا، وما فاتكم فأتموا
This includes the one who arrives in the first, second, third, or fourth rak'ah, or in the tashahhuds; the hadith covers him. So if they join him in the prayer, sit for the tashahhuds, and prostrate with him in the final prostration; this is better and more in accordance with the apparent Sunnah.
And if they pray as a congregation after the imam's taslim, anywhere in the mosque, we hope there is no blame on them. But my advice, and what I see as better and more in line with the Sunnah, is that they join the imam, even if it is at the end of the prayer; taking the hadith into account:
and pray whatever you get (with the people) and complete the rest which you have missedما أدركتم فصلوا، وما فاتكم فأتموا

As for the statement of some scholars that the takbir of ihram suffices for the ruku', their basis is that they are two acts of worship of the same type, so the smaller one is included in the larger one. The smaller one is included in the larger one: two acts of worship, "Allahu Akbar," two acts of worship at one time when he reaches the row and the imam is in ruku', so they coincide in time. And there is a fear that by saying both, he would miss the rak'ah, so the smaller one is included in the larger one. Just as if one arrives at the mosque and it is prescribed for him to pray the greeting of the mosque, he prays the two rak'ahs of the rawatib, for example the rawatib of the Zuhr, or the rawatib of the Fajr, and it suffices for him for the greeting of the mosque.
And likewise, if the obligatory prayer is being performed when he arrives, it suffices for him for the greeting of the mosque, and it is included in the larger prayer. This is one of their proofs.
Likewise, if one performs the ghusl of janabah with the intention of both states of impurity, it suffices for the wudu'; because the wudu' is a smaller act of worship included in the larger act of worship. So if he intends both, the larger one suffices for the smaller one. In this, a group of the Companions of the Prophet (peace and blessings be upon him) issued a fatwa that the takbir of ihram suffices for the takbir of ruku'; so that he does not miss the rak'ah. And this is from the category of prioritizing the greater by leaving the smaller. This is the perspective of the one who issued this fatwa.
