Question:
From the city of al-Najilah in Matruh Governorate, Arab Republic of Egypt, the listener Muhammad Jibril al-Mallah asks and says: If I enter the mosque and find the worshippers in the final tashahhud, and I sit with them until the taslim, am I then required to go back to establish the prayer? Knowing that I did not say the takbirat al-ihram. May Allah reward you with good.

Answer:
If you did not say the takbir, and you sat down without the takbir, then you have no prayer, and you must say the takbir when you begin the prayer. However, it is better for you, if you arrive while they are in the final tashahhud, to say the takbirat al-ihram while standing, then sit with them and recite the tashahhud. Following the imam is better. Then, when the imam says the taslim, you stand up and complete your prayer. This is based on the saying of the Prophet (peace and blessings be upon him):
If one of you comes to the prayer, let him walk, and let him have calmness and composure. Whatever he catches, he prays, and whatever he misses, he completes.إذا أتى أحدكم الصلاة؛ فليمش، وعليه السكينة والوقار، فما أدرك؛ صلى، وما فاته؛ أتمه
And in the other wording:
and pray whatever you get (with the people) and complete the rest which you have missedفما أدركتم؛ فصلوا، وما فاتكم؛ فأتموا

So the sunnah for one who arrives while the imam is sitting in the final tashahhud is to join him in the prayer, and to say the takbirat al-ihram while standing, then sit down. And if he says the takbir when sitting, there is nothing wrong with that. He recites the tashahhud, then when the imam says the taslim, he stands up and prays the rest of his prayer. Yes.
