Then the Muslim may do what warrants his imprisonment, even if the state is ruling by the law of Allah, so the Muslim may engage in what warrants his imprisonment from his aggression against some people, and from his taking of people's money, and his failure to pay... until he pays the debt, and from his aggression against... until it is established against him... and what he deserves of discretionary punishment, or a fixed punishment, or the like, so it is not strange, rather what is strange is that he is imprisoned without right, or imprisoned in obedience to Allah and His Messenger, this is what is strange.
As for the fact that there are Muslims in the prisons, this has been the case since the time of the Prophet (peace and blessings be upon him) and after him, it is necessary that one who transgresses the limits—even if he is a Muslim—must be detained until the command of Allah is executed upon him, and his imprisonment may be long, and it may be short according to the condition of the ruler, and his implementation of the Shari'ah of Allah, and according to the strength or lightness of the crime, and other such reasons.
