The ruling on uttering divorce repeatedly for the purpose of teaching
Machine translationRead the Arabic original
A message was sent by our brother Abd al-Rahman Tahir from North Yemen, stating that he resides in Riyadh. He says: I was sitting with one of my friends joking, and one of them said to me: What does a man say when he divorces his wife? So I said: He says: You are divorced, you are divorced, you are divorced. Then they said: You have now divorced your wife. They put doubt in my mind, especially since they informed my wife of what I said. Please advise us, if you would be so kind?
Answer: If your intention was to explain how a divorcing man should act, then you owe nothing, and no divorce is considered from you if the intention behind this speech was that you were clarifying to them how one who wants to divorce should do it. This is nothing upon you. However, you erred in repeating the divorce in this teaching. It is sufficient to say it once. He says: (You are divorced) and he is content with that and does not repeat it. This is what is prescribed, and it is not obligatory to repeat it three times; because this blocks the door of ease. Allah, Glorified and Exalted is He, made divorce sequential: one, then two, then three, so that the matter is not made difficult for the husband. He may divorce her once and then wish to take her back, so he has room for taking her back. And he may divorce her twice and then wish to take her back, so he has room for taking her back. But if he divorces her the final time, it is finished; she is not lawful to him until she marries another husband. So you taught him the divorce that makes her unlawful to him. So the matter is not as you said. But the Sunnah is to divorce once. It is said: The Sunnah for a man when he wants to divorce is to say: You are divorced, you are divorced, or So-and-so is divorced. This is what is prescribed, only once.
In any case, you owe nothing, as long as you intended clarification by it, and if you erred in the clarification, then there is nothing upon your wife, and the wife remains in your guardianship even if the news reaches her, if the reality is what you said, if you did not lie in the speech. If the reality is what you said, then you owe nothing, and there is nothing upon your wife, and praise be to Allah.
But you must be well-mannered and not issue a ruling on anything while you are not knowledgeable. If you are asked about something, do not say except what you know with evidence from the speech of Allah or the speech of the Messenger of Allah (peace and blessings be upon him), or from what you heard from the people of knowledge. You say: I heard So-and-so the scholar say such and such. You transmit from So-and-so the scholar what you have memorized and preserved that he said such and such in prayer... in fasting... in Hajj... in zakah... in other matters. But as for saying something while you are ignorant, it is not permissible for you; because Allah says : [Al-A'raf:33] So the Muslim does not say about Allah without knowledge. And He said : [Al-Baqarah:169] So He, the Exalted, clarified that Satan commands us with lewdness and what is wrong, and saying about Allah without knowledge. He commands us with evil, lewdness, and saying about Allah without knowledge.
So it is not for us to obey Satan, but it is obligatory for us to fight him and not to say except with knowledge. Otherwise, we must hold back and refrain from that until we learn and until we ask the people of knowledge. And success is from Allah. Yes.

Say, "My Lord has only forbidden immoralities - what is apparent of them and what is concealed - and sin, and oppression without right, and that you associate with Allah that for which He has not sent down authority, and that you say about Allah that which you do not know."
(168) O mankind, eat from whatever is on earth [that is] lawful and good and do not follow the footsteps of Satan. Indeed, he is to you a clear enemy. (169) He only orders you to evil and immorality and to say about Allah what you do not know.
So it is not for us to obey Satan, but it is obligatory for us to fight him and not to say except with knowledge.
