Shaykh Abdul Aziz, four letters have come to me in this session from men asking about divorce.
The first letter is from Libya, and its sender is our brother Muhammad Abdul Hamid Sa'id. He divorced his wife four times and is seeking a ruling.
As for the second letter, it is from the Hayy al-Sha'b district in Baghdad. Our brother says that he divorced three times and is also seeking a ruling.
Then our brother Shuqayqay Miloud from Algeria says: He wrote a document, and its text is that she is in her desire, and this phrase is known among them to mean divorce.
As for our brother Saleh al-Sayyid al-Jurjawi, he says that he divorced with three pronouncements and sent it recorded on a tape, specifying the period of divorce as one year. They are seeking a ruling on these matters in the chapter of divorce, if you would be so kind, O Shaykh?
Answer: In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, Lord of the worlds, and may blessings and peace be upon His servant and messenger, His choice from among His creation, and His trustee over His revelation, our Prophet, our Imam, and our Master Muhammad ibn Abdullah, and upon his family and his Companions, and whoever follows his path and is guided by his guidance until the Day of Judgment.
As for what follows: I answer my brothers who are asking about these issues related to divorce by advising them to consult the mufti in their country and explain the situation to him, along with what I consider, if Allah wills, to be sufficient, or to the court that handles personal status matters in accordance with Islam, so that they may issue a ruling on the matter. This is because the situation requires the presence of the husband, the divorced woman, her guardian, and those who witnessed the events; it may require all of this. The judge or mufti will examine the matter and question those present, asking the husband and the wife about what they have to say, and asking the guardian, as the husband may say one thing while the truth is otherwise. Therefore, the situation requires care and caution. My advice to these questioners is to contact the muftis in their area and explain the reality to them. The mufti or judge will look into the matter, and if the need arises for the judge or mufti to write to me about any of this to reach an understanding regarding what may be difficult, I have no objection to that. All of this is in the category of cooperating in righteousness and piety and advising one another in the path of Allah .
