The question: He says: Is there zakah due on the land gifted to me by the ruler if it is offered for sale? And what if it is not offered for sale, meaning: I have not announced it, but I have no objection to selling it suddenly, especially if prices rise? And does the ruling differ if I bought it and have not offered it for sale up to now? And if I sell it, do I pay zakah immediately, or must the lunar year (hawl) pass?
The answer: Lands that a person owns by gift from the ruler, or by purchase, or by gift from another person, differ in ruling. If he intends to sell and trade in them, then zakah is obligatory on them if the lunar year (hawl) passes over them. But if he intends to build a residence on them, or build a place for rental, or if he is undecided and has not resolved on anything—will he build a residence? Will he build buildings for rental? Will he sell them?—then if he is undecided, there is no zakah on him. Or if he did not intend them for sale but intended them to build a residence or a place for rental on them, then there is no zakah in them. But whenever he rents them out, or builds on them and rents them out, then zakah becomes obligatory on the rent if the lunar year (hawl) passes over it. As for if he has resolved that he wants them for sale and that he intends to sell and trade in them, then he pays zakah on them when the lunar year (hawl) passes over them. He pays zakah on the value. He looks at their value and asks the experts: What are they worth? Then he pays zakah on the value after the lunar year (hawl) has passed over them after his ownership of them by gift or otherwise. Yes.
