Question:
If a person has a building that he rents out annually, does he pay the zakah from its income, or from its value?

Answer:
If he uses it for rental and not for sale, he pays zakah on the rental income. However, if he intends it for trade, or considers it for trade, while he is renting it out and it is prepared for trade, he pays zakah on the whole: he pays zakah on the rent and on the value every year.
As long as it is prepared for rental and he has not considered it for sale, he pays zakah on the yield when the lunar year has passed.
