The ruling on one who is threatened with death if he commits unlawful sexual intercourse

Machine translationRead the Arabic original
Question:
A servant was working for one of the women, so on one day she said to me: If you do not commit unlawful sexual intercourse with me, I will kill you. She threatened me with a weapon, which was in her hand. What should I do? Should I refuse and accept being killed? What is the solution?

Answer:
We ask Allah for well-being and safety! This is a serious question—may Allah grant us well-being—and it is obligatory for him not to submit to this demand, and to strive to escape from her, and to distance himself from her and from serving her; because this is what is obligatory for him: to distance himself from what Allah has forbidden, and to seek any means he can to distance himself from what Allah has forbidden, and not to agree with her to commit the sin.
But if it is assumed that he was unable to do so, and that he had no choice but unlawful sexual intercourse or being killed; then the correct opinion among the scholars is: that he is in the ruling of one who is coerced in this case, so he is coerced, and the coerced person is not held accountable. If the coerced person is truthful, he is not held accountable, and he is unable to have intercourse. This is the known fact; because the coerced person’s temperament is disturbed, and his self is disturbed, so he is unable to do it. So if he tried, he would not be able to. But if it were decreed that he was compelled to do this thing, or to be killed; then this would be easier with repentance to Allah, and with doing what he is able to do if he is truthful.
