Question:
And one of the brothers says: If I distinguish one of my sons by writing money for him, because I did not give him the opportunity I gave his brothers, or because he did not marry like them, or because he is sick, or blind, can I give him something from my money?

Answer:
The Prophet (peace and blessings be upon him) said:
Fear Allah and be just among your children. Would it not please you that they should be equal in kindness? He said: Yes. He said: Then do not do so. And he said: I do not bear witness to injustice.اتقوا الله، واعدلوا بين أولادكم، أفلا يسرك أن يكونوا في البر سواء؟ قال: بلى، قال: فلا إذًا، وقال : إني لا أشهد على جور

The point is: It is obligatory for a person, whether male or female, the father or the mother, to be just among their children. They are not allowed to be unjust, so they do not give to the son and leave the daughter, nor give to some of the children and leave the rest, nor give to some of the daughters and leave the rest. Rather, he must be just among them all, even if one of them is not as capable as the other. If one is capable and one is not, and one has wealth and one has no wealth, he equalizes between them and is just among them.
But maintenance is permissible if one is poor and has no means, and one is made wealthy by Allah; he maintains the poor one until Allah makes him wealthy, because this is part of the obligation of maintenance and part of kindness.
So the poor person, the blind person, and the sick person who has no means, and whose father is able to provide maintenance, he maintains him, and this is not injustice. And the children whom Allah has made wealthy and who have wealth do not need maintenance. And when he marries them, he marries all of them, unless some of the married ones have been made wealthy by Allah; then he marries himself from what Allah gave him, and the incapable one his father marries him from what Allah gave him, if he is incapable, like in the case of maintenance.
As for distinguishing one for such a reason, or for such a reason, while all are equal in money, no, he does not distinguish this one because he is blind, or distinguish this one because he is more pious, or distinguish this one because he has, for example, many children, or something similar, unless he is poor.
The point is: He does not distinguish one over another except for a legal reason, such as maintenance for the poor and incapable person who cannot work, or because he wants to equalize between them in the gift, so he gave this one, then gave the rest, not for the sake of distinction, but to give them the same, or something similar to that which involves equalization.

Question: O Shaykh, regarding the equalization between the male and the female?

Answer: According to the inheritance, this is the stronger of the two opinions.
