The Ruling on Marriage Between the Khudhairi and the Qabaili

Question:
There is a common belief among people regarding the Khudhairi and the Qabaili, that the Qabaili does not marry a Khudhairi woman, and the Khudhairi does not marry a Qabaili woman. Is there a hadith that abolishes this matter which people are now concerned about, or which occupies their minds regarding their daughters?

Answer:
This is something with no basis, and it is not among the conditions of marriage. However, it has a basis in the sense that people are of different types, lineages, tribes, and categories. Every tribe prefers to marry within its own tribe if that is feasible. Sometimes they shout at whoever marries his daughter to someone from another tribe, sometimes they disapprove of him, and sometimes they are lenient in this regard. Otherwise, the matter is equal in this respect. He (Exalted and Majestic is He) said:
O mankind, indeed We have created you from male and femaleيَا أَيُّهَا النَّاسُ إِنَّا خَلَقْنَاكُمْ مِنْ ذَكَرٍ وَأُنْثَى
[Al-Hujurat:13], meaning from Adam and Eve,
and made you peoples and tribes that you may know one anotherوَجَعَلْنَاكُمْ شُعُوبًا وَقَبَائِلَ لِتَعَارَفُوا
[Al-Hujurat:13]. He did not say "so that you may boast," but He said "so that you may know one another."
Indeed, the most noble of you in the sight of Allah is the most righteous of youإِنَّ أَكْرَمَكُمْ عِنْدَ اللَّهِ أَتْقَاكُمْ
[Al-Hujurat:13]. If piety is achieved, that is the great foundation. So, seize the one with faith, and may your hands be rubbed in the dust.
The point is that people are equal in this regard. There is no harm in the Arab, the freed slave, and the non-Arab marrying among themselves, and marrying one another. The Arab may marry a non-Arab woman, and the freed slave may marry a freed woman, and there is no harm in that, nor any blame.
Indeed, the most noble of you in the sight of Allah is the most righteous of youإِنَّ أَكْرَمَكُمْ عِنْدَ اللَّهِ أَتْقَاكُمْ
[Al-Hujurat:13]. The Prophet (peace and blessings be upon him) married Usamah ibn Zayd, who was a freed slave, and his father was a freed slave named Zayd. He married both of them to women from Quraysh. He married Zayd to Zaynab, who was an Asadi, and her mother was from Banu Hashim. He married Usamah to Fatimah bint Qays, who was a Qurayshi woman. This indicates that the matter is broad in this regard. Similarly, he married 'Abd al-Rahman ibn 'Awf to Bilal, who was a Habashi, and she was a Zahri, a Qurayshi woman.
The point is that these matters have breadth, praise be to Allah, and there is nothing in them that necessitates prohibition. However, ignorance, arrogance among some people, tribal pride among some people, and the fear of some people of others may lead to things of this kind.
When knowledge becomes established among people, and religion becomes established among people, these matters will disappear, and the legal ruling will be settled. But due to ignorance, many things of this kind occur, and more. As for "Khudhairi" and "Qabaili," they have no basis. The original, ancient basis is to say: "Qabaili," "Mawla," or "A'jam." As for "Khudhairi," this is something new, that has occurred recently; we do not know when it occurred. What is known is "Qabaili," which is from the Arab tribes, "A'jam" from the non-Arabs, and "Mawla" meaning a freed slave. These people are from the party of these known origins. There is no harm in marrying from these people. There is no harm in the Arab marrying a non-Arab woman, the non-Arab marrying an Arab woman, the Arab marrying a freed woman, and the freed woman marrying an Arab. All of this is permissible in Islam, and there is no blame in it.
