The Committee of Senior Scholars has established this when they studied the rulings on narcotics, the great harm they have caused to Muslims, the major corruption, and the loss of many young people and others due to their use of these narcotics, their insistence on them, and their continued use. They examined the words of the scholars, and it was established from that:
That the one who smuggles them from here to there must be executed; because of his corruption on earth; because he falls under the category of corruption on earth, and because he is also more severe than the one who wages war against Allah and His Messenger. If the one who wages war, who takes people’s money on the roads, is executed, then this one who corrupts people’s minds is more deserving of execution.
As for the one who promotes them by buying and selling; then he is disciplined, and given a discretionary punishment as the one in authority sees fit, such as imprisonment and discipline, if that deters him. Otherwise, he must be executed; because his execution preserves the minds of Muslims and preserves their lives. So it was a mercy from Allah to the servants that He prescribed discretionary punishment by execution; for what discipline by flogging, imprisonment, and the like does not deter.
And this is the aspect of the ruling that was issued in that matter; because it is corruption on earth; and because it is more severe than waging war against Allah and His Messenger, which is taking money without right, on the roads, and in similar places in the countries by force. So if the one who takes people’s money, or frightens people on the roads, is executed, or crucified, or his hand and foot are cut off, then the one who corrupts people’s minds, and smuggles what harms their minds, and corrupts their religion and their worldly affairs, is more deserving of this punishment—may Allah grant us safety.
