What is the ruling on building a house above a mosque?

The questioner : Our Shaykh, Shaykh Abu Malik, is currently building in a mosque, may Allah reward him with good, on the Salat road after Suwaylih. There are brothers there among the guards, and people come to work, supervising the electricity or the plumbing, or whatever else is needed. So they asked me: "The Shaykh has placed a house above the mosque; is this permissible or not?" I said: "By Allah, I mean I cannot give you a fatwa on this, but I will ask for you. So, is it possible to point us to a Shari'ah ruling on this?"

The Shaykh : I was asked this question, and my answer to it is that there is an incorrect opinion, of course, that the mosque extends to the seven heavens, meaning that the air above the mosque is in the ruling of the mosque, and it is not permissible to erect a building on it. This has no basis. However, if this mosque is built as a house for its owner to live in, one thing should be observed: the bathrooms should be like a balcony or a terrace, outside the structure of the mosque. This is in the context of . As for the mosque being under you while you defecate above it, this is a violation of this Shari'ah etiquette. This is one of the matters that requires attention and jurisprudence, and we ask Allah to grant us understanding and jurisprudence in the Book of Allah and in the hadith of the Messenger of Allah (peace and blessings be upon him).
