Question:
What is the ruling on playing with divorce? And if a man says to his wife while joking, "You are divorced," but he says he does not intend the divorce to be valid?

Answer:
Answer: If he utters the words of divorce, it takes effect, unless he is of unsound mind. If he is of unsound mind, or if he is in a state of extreme anger such that he cannot comprehend what he is saying due to the intensity of the anger, then it does not take effect. But if he is of sound mind, then uttering the words of divorce takes effect, even if he is joking or being flippant. The Prophet (peace and blessings be upon him) said: "Three matters are serious whether done in seriousness or in jest: marriage, divorce, and taking back a wife."
