The ruling on fasting and determining the festivals based on the calendar

Machine translationRead the Arabic original
The first question of Fatwa No. ( 20400 )
Q1: In the country of India , the month of Ramadan and the festival of 'Id al-Fitr are determined based on the (annual calendar) issued by the Indian Parliament, meaning: it is determined at the beginning of each year. Also, the blessed festival of 'Id al-Adha is determined by the (annual calendar), and not based on standing at 'Arafah . Here, the custom is that they sacrifice after the Muslims, especially in the Arab countries. Our question is specifically about fasting in Ramadan. We usually fast after a telephone call with our relatives in Saudi Arabia or Kuwait , or generally in the countries of the Gulf , which is usually before the fasting of the Muslims of India . Is our fasting valid or incorrect? Knowing that most foreign students in the country of India fast after the sighting of the moon from the countries of the Gulf . I ask for your guidance.
A1: It is obligatory for you to fast with the Muslims in your country, and it is not permissible for the people of one country to differ in this matter; due to the saying of the Prophet (peace and blessings be upon him):
Fasting is the day you fast, breaking the fast is the day you break the fast, and the Festival of Sacrifice is the day you sacrifice.الصوم يوم تصومون، والإفطار يوم تفطرون، والأضحى يوم تضحون
. The establishment of the month in the Shari'ah is by sighting with the naked eye,
or by means that assist the eye in seeing. If the crescent is not seen, it is obligatory to complete the month as thirty days; due to the saying of the Prophet (peace and blessings be upon him):
Fast when you see it and stop fasting when you see it, and if it is obscured from you (too cloudy), then complete thirtyصوموا لرؤيته وأفطروا لرؤيته، فإن غم عليكم فأكملوا العدة
Sunan an-Nasa'i 2124Sahih (Darussalam)
agreed upon by al-Bukhari and Muslim. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
