Fatwa number ( 20140 )
Q: If the deceased died after the days of Tashreeq, is it permissible to slaughter the 'Id sacrifice on his behalf? Because there are people who, if a person dies during the month of Dhu al-Hijjah, slaughter the sacrifice on his behalf, even if it is at the end of the month?
A: The days for slaughtering the 'Id sacrifice for the deceased and others end with the setting of the sun
on the thirteenth day of the month of Dhu al-Hijjah; due to the saying of the Prophet (peace and blessings be upon him):
All the days of Tashriq are days of slaughterكل أيام التشريق ذبح
Sunan al-Bayhaqi 17:224
narrated by Ahmad and al-Haythami in Majma' al-Zawa'id. And 'Ali (may Allah be pleased with him) said: The days of slaughter are the day of 'Id al-Adha and the three days following it. Ibn al-Qayyim said: (And because these days are distinguished by being the days of Mina , and the days of Tashreeq, and fasting on them is forbidden). End of quote. Therefore, slaughtering the 'Id sacrifice after these days have passed is not sufficient, except for the obligatory sacrifice by bequest, vow, or designation, for it is slaughtered after these days as making up for whoever missed slaughtering during them. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
