All praise is due to Allah alone, and peace and blessings be upon the one after whom there is no prophet. After that: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Grand Mufti from the questioner, the head of the publishing unit at the Islamic institution in Kelantan, Malaysia \ Luqman ibn al-Hajj 'Abd al-Latif ibn Sulayman , through the acting Director General of Da'wah Abroad, and referred to the Committee by the General Secretariat of the Council of Senior Scholars with number (5836) and date 10\11\1413 AH. The questioner asked a question, the text of which is: It is my pleasure to clarify to Your Eminence our difficulty regarding the permissibility of the sacrificers giving, donating, or presenting the skins of the sacrificial animals to any reform committee or body in each district to take charge of benefiting from them — I mean benefiting from their price by selling them to a Muslim skin merchant — in such things as erecting prayer halls and mosques, or Qur'an schools, or Islamic kindergartens, or paying stipends to mosque attendants, or buying mats or cleaning supplies, or fencing in Muslim graveyards, or for other reform purposes that return good to the general Muslim population in the district of these sacrificers?
I have read in the book: (Al-Targhib wa al-Tarhib from the Noble Hadith) a hadith from Abu Hurayrah (may Allah be pleased with him) who said: The Messenger of Allah (peace and blessings be upon him) said:
Whoever sells the skin of his sacrificial animal, he has no sacrificeمن باع جلد أضحيته فلا أضحية له
Sunan al-Bayhaqi 17:215
It was narrated by al-Hakim and he said: The chain is authentic. The Hafiz said: In its chain is 'Abdullah ibn 'Iyash al-Qibani al-Misri - about whom there is disagreement, and it has come in more than one hadith from the Prophet (peace and blessings be upon him) the prohibition of selling the skin of the sacrificial animal . Then in the footnote is an explanation of the meaning of (so he has no sacrifice), meaning he has no reward for it, Al-Kamil (page 156, volume two) - Dar Ihya' al-Turath al-'Arabi edition - Beirut , and the issue is that the sacrificers do not sell those skins directly, but rather they donated or gave or presented them all to the representatives of that Islamic body or committee, and by that its ownership transferred to it, and it is known that those who receive the meat of the sacrifices may be from the wealthy, the poor, and the needy
as long as they are Muslims and they are individuals, whereas those committees or bodies are not individuals, but rather they are legal, juridical, or moral persons, as if they represent the Muslims of the region. The skins of the sacrifices may be buried, not benefiting from them in our midst today, and we see that it is not befitting for Muslims to waste them entirely, as we see that it is better for the authorities to take a reform step that is orderly and organized for the stage of building skin factories in every Islamic country, starting from this Islamic foundation, which spoke about the skins not only in the Prophetic hadith but also in the Noble Qur'an. I ask Your Eminence to graciously respond and issue a fatwa in this particular matter, may Allah reward you for the Muslims of Malaysia with good, considering that after attempting to search in the collected books of fatwas I was not successful in obtaining a resolution of the problem, and your hastening with the fatwa will benefit us urgently for the call before our reception of the Festival of Sacrifice this year. And to Your Eminence is my sincere supplication, and may Allah protect you and preserve you and guide our steps, us your Malaysian sons, with your guidance.

A: After the Committee studied the inquiry, it answered that if the skin of the sacrificial animal is given to a poor person or his agent, there is no harm in selling it and the poor person benefiting from its price, and the only one prevented from selling it is the sacrificer himself. Likewise, there is no harm in charitable associations selling the skins of sacrifices they obtain and spending the value for the benefit of the poor.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
