Q: I went to Makkah al-Mukarramah with my family this year to perform the rites of Hajj, and in Mina we encountered severe congestion while stoning the pillars on the first day of Tashriq. On the night of the twelfth, while we were in Mina , the Islamic awareness car passed by, explaining to people the rites of Hajj and what they must do on the days of Tashriq. I told them about the hardship and difficulty I had experienced, as I am an elderly man, while stoning the pillars on the first day of Tashriq. The Shaykh permitted me to stone the pillar on the second day of Tashriq at night at twelve o’clock
from the night of the twelfth of Dhu al-Hijjah. So I stoned the pillar of the second day of Tashriq at one o’clock in the morning on the 12th of Dhu al-Hijjah, on behalf of myself and my six children. I had no one with me whom I could appoint as my agent for myself and my young children and my wife. After returning to my place of work, one of the people issued a fatwa to me that it is obligatory for me to offer a sacrificial animal for each person for whom I stoned at night, despite his knowledge of my advanced age, the large number of children with me, their young age, and the fatigue and hardship I experienced in the previous stoning of the pillars. Therefore, I ask you, may Allah guide your steps and benefit us with your knowledge, to send us an official fatwa from you so that we may be informed about the matters of our religion
A : The time for stoning the pillars on each of the three days of Tashriq begins after the sun passes its zenith (zawal) on each day. Accordingly, your advancing the stoning of the pillars of the twelfth day to the middle of the night of the twelfth at one o’clock in the morning is performing the rite outside its prescribed time. Therefore, it is obligatory for you and for each person you mentioned to perform an expiation similar to your action: a sacrificial animal to be slaughtered in Makkah and distributed to the poor of the Haram. And whoever cannot do so, he should fast for ten days. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
