The questioner : She says: My husband and I performed the obligatory Hajj last year, and praise be to Allah, we performed all the rituals except for the Tawaf al-Ifadah, which I alone did not complete. I am, praise be to Allah, in full health and strength, but due to the severe crowding and fear of fainting—and I actually began to feel as if I was suffocating—I left during the first lap of the Tawaf. My husband performed the Tawaf in the early morning of the second day, and we left the Noble Makkah. I did not have sufficient time left. Please advise us, may Allah reward you. What is obligatory for me to do after this period has passed? I am awaiting your answer?
The Shaykh : The truth is that this issue is one of the important matters that should not be delayed in asking about until such a time, after eleven months have passed since the Hajj, if you performed it last year, or more if you performed it before that.
The questioner : Yes.
The Shaykh : And in such a case, according to what we know from the words of the scholars, you are still in your Hajj, because the Tawaf al-Ifadah is a pillar that is necessary. For this reason, when it was said to the Prophet (peace and blessings be upon him) that Safiyyah (may Allah be pleased with her) was menstruating, he said: And if one could act on behalf of another in the Tawaf al-Ifadah, there would be no detention, and it would have been possible for the Tawaf to be performed on behalf of Safiyyah. And the Messenger (peace and blessings be upon him) did not say: And on this basis, you are still in Hajj, and it is obligatory for you now to go to Makkah and perform this pillar that Allah has made obligatory upon you in His saying: [Al-Hajj 22:29].
And this is also in accordance with the rules of the scholars, and indeed with what the Sunnah has brought, which is that the second state of permissibility (tahallul) is not achieved except by the obligatory Tawaf and Sa'y. You are considered to have not achieved the first state of permissibility. So we ask Allah to help us and you. This is what we see in this issue, and if you wish to seek a ruling from others in this matter, there is no blame on you.
The questioner : Yes, may Allah reward you with good.

Are we detained?

أحابستنا هي؟Then let them end their untidiness and fulfill their vows and perform Tawaf around the ancient House."
