Q: I own a small gas station—praise be to Allah—and I have rented it out to another party, which is a company. I wish to ask here: Who is obligated to pay the zakat on the station: the tenant, who is currently benefiting from it and whose contract is for three years, or the owner?
A: There is no zakat on the station building, nor on its tools prepared for use. Rather, zakat becomes obligatory on the tenant on the produce he obtains
from it, provided it reaches the nisab and a lunar year has passed from the time it was obtained. Zakat is also obligatory on the lessor on what he receives from the rent of the station, provided it reaches the nisab and a lunar year has passed from the time of the contract. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
