Fatwa number ( 20798 )
Q: I seek a fatwa from your eminence, may Allah preserve you, regarding a fuel station that I sold for a sum of four hundred thousand riyals. Sixty thousand riyals were received in cash, and two hundred and twenty thousand riyals were deferred, consisting of: a 1982 model salon car for forty thousand riyals, forty head of livestock for forty thousand riyals, and a 1983 model Mercedes for one hundred and forty thousand riyals. The remaining one hundred and twenty thousand riyals were to be paid over two years, sixty thousand riyals each year. The aforementioned man used the station for a period of two years. After the two years ended, I demanded my right from him, but he refused to give me my right and said: "Buy the station." I said: "Do you want to delay me?" He said: "Buy the station." So I bought the station for a sum of two hundred and seventy thousand riyals: one hundred and twenty thousand riyals were with him, and I paid one hundred and fifty thousand riyals for it. I ask your eminence for a legal ruling on this matter to clear my conscience: is the sale valid, or does it contain riba, so that I may be clear about what clears the conscience? .
A: Your purchase of the gas station that you sold after the buyer used it for two years and was unable to pay the remaining amount is permissible in the Shari'ah, and it is not considered
one of the issues of 'inah that is forbidden in the Shari'ah, provided that the buyer's use of the aforementioned station has changed its characteristics, and the money he obtained is the produce of his property while it remained with him for two years. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
