Q: My entire family, numbering fifteen people, including two who had not yet reached puberty, and the rest who had reached the age of maturity, descended to Makkah al-Mukarramah with the intention of performing Hajj, on the night of Tarwiyah. Some of us went to the Makkah Haram for tawaf and sa'y, while the others stayed in Mina on the night of Tarwiyah. We were all present in Mina on the day of Tarwiyah. Your Eminence knows what happened in Mina on the day of Tarwiyah: a fire broke out that consumed our tent and all our belongings. We fled with our lives to the tops of the mountains. When the fire was over, we returned to our tent and found it completely burned along with all its contents. Some members of my family suffered from suffocation and difficulty breathing, which made it difficult for them to continue the rituals of Hajj. Due to the inability of some family members to continue the Hajj, and due to the burning of our tent and all our belongings, we abandoned the Hajj because of this harsh circumstance that held us in Mina on the day of Tarwiyah before we could stand at 'Arafah. We returned to our homes and exited our state of ihram, hoping that, if Allah wills, we will perform Hajj next year. I ask Allah, then your Eminence, to answer my question: Do I owe a sacrificial animal, or what? May Allah reward you with the best reward.
A: As for any of you for whom it becomes impossible to proceed with the Hajj due to the aforementioned obstacle, his ruling, and the ruling of the person accompanying him whom he needs, is the ruling of one who is prevented (muharr): each one must slaughter a fidyah, which is a sheep that is acceptable for the 'Id sacrifice, or one-seventh of a camel, or one-seventh of a cow, and then exit the state of
ihram. In this case, the slaughter takes place in Makkah, and the meat is distributed to the poor of the Haram. If the ihram he entered was for the Hajj of Islam, it is obligatory for him to perform it whenever he is able to do so. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
