The questioner : The honorable Shaykh says: One who died in the Mina fire this year, and this was his Hajj of Islam, should someone perform Hajj on his behalf?

The Shaykh : Yes. If one dies in the fire after entering the state of ihram, then no one should perform Hajj on his behalf, because the Prophet (peace and blessings be upon him) said regarding the man who died on the Day of 'Arafah:
Bathe him with water mixed (with the leaves of) lote tree and shroud him In his two (pieces of) cloth and cover neither his head nor his face, for he would be raised on the Day of Resurrection pronouncing Talbiya. اغسلوه بماء وسدر، وكفنوه في ثوبيه ولا تخمروا رأسه ولا تحنطوه. فإنه يبعث يوم القيامة ملبيا
Sahih Muslim 1206f
. And Allah the Exalted said:
And whoever leaves his home as an emigrant to Allah and His Messenger and then death overtakes him - his reward has already become incumbent upon Allah
[An-Nisa 4:100]
. Accordingly, if he had entered the state of ihram, then no one should perform Hajj on his behalf. His conscience is thereby cleared. It is not recommended to complete the rites on his behalf, because if...
First: because the Prophet (peace and blessings be upon him) did not order that the rites be completed for the man who died at 'Arafah. He did not say, "Complete the rites on his behalf." And because if they were completed, the implication of this completion would be that the deceased is released from the rites. In that case, it would be forbidden for him to be sent forth on the Day of Resurrection while reciting the talbiyah. This would be a wrong done to him. If it were said that completing the rites on behalf of the deceased is forbidden—if that were said—it would be a sound opinion, because that is a wrong done to the deceased in reality.
As for if he had not entered the state of ihram. If he had not entered the state of ihram, meaning: he burned before he entered the state of ihram, then it is looked into. If in the past years he was able to perform Hajj but he postponed it to this year, then it is made up from his estate.
And as for if he was not able to perform Hajj except in this year of his, then it is not made up on his behalf, because he was not able to perform it.
Yes.
