Is it valid for us to perform tamattu' when we did not arrive in Makkah until after the sun passed its zenith on the Day of Tarwiyah, and we did not enter the state of ihram for Hajj until the sunset of that same day, or was it obligatory for us to perform qiran?

The questioner : The questioner from Bisha, A.M., asks: "O honorable Shaykh, is it valid for us to perform tamattu' when we did not arrive in Makkah until after the sun passed its zenith on the Day of Tarwiyah, and we did not enter the state of ihram for Hajj until the sunset of that same day, or was it obligatory for us to perform qiran?"

The Shaykh : What should have been done by one who arrives in Makkah after the people have left for Mina, which is on the morning of the eighth day, is to go out to Mina for Hajj, either as qiran or as ifrad. This is because engaging in Hajj during the time of Hajj is better than engaging in 'Umrah, since 'Umrah can be performed at another time, whereas the time for Hajj is missed if it passes. Therefore, we say to the one who arrives in Makkah on the morning of the eighth day: It is better for you to enter the state of ihram for Hajj and 'Umrah as qiran, or for Hajj alone as ifrad, because there is no place for 'Umrah now. The time now is for Hajj. If someone asks, "Is it not permissible for a person to delay and not go out to Mina until the night, or not to go to Mina at all and go directly to 'Arafah?" The answer is yes, that is permissible. However, this does not mean that when the time for Hajj arrives, if a person delays entering the state of ihram for Hajj or going out to the sacred sites, he can do whatever he wants. Rather, we say that it is better, when the time for Hajj enters, that a person not engage in anything else. Yes.

The questioner : May Allah reward you.
