Q: I present to your Eminence that I have two paternal cousins. The name of the first is (Thalibah), and the second is: “Halibah.” They both passed away before they could perform the Hajj of Islam, and they were widows. In this year, 1410 AH, I hired two men to perform Hajj on their behalf from the best of the land, and I have no doubt about them. The one who performed Hajj for the obligation of “Thalibah” was “Husayn.” He took a paper with the name of the woman for whom he was performing Hajj, “Thalibah.” The second is “Halibah.”
So the one invited, “Yahya,” performed Hajj for her but did not take a paper with the name “Halibah,” relying on the fact that he knew her name perfectly, as he is from the family and the tribe. However, both Hajj pilgrimages took place in this year, 1410. The two men mentioned are from the tribe, they are believers, and there is no doubt about them. They set out for Hajj with the blessing of Allah—though each traveled separately in a car—following the rituals. They did not agree on the details until after the festival, when each went to take a paper to write the name of the woman for whom he was performing Hajj. They questioned each other, and each said: “I performed Hajj for the obligation of ‘Thalibah’ and declared my intention for ihram, tawaf, standing at ‘Arafah, and stoning the pillars in the name of ‘Thalibah.’ I have prevented ‘Halibah’ from Hajj.” The two men returned with only the Hajj of “Thalibah.” As for “Husayn,” he took a paper with the name of Thalibah before setting out for Hajj and kept it with him at the sacred sites. The second man declared his intention for Hajj and ‘Umrah as a mutamatti’ (combining them), but strong forgetfulness prevented him from remembering her name, “Halibah.” He declared his intention in the name of “Thalibah,” thinking that the Hajj was in her name since they were sisters, and he did not know that “Husayn” had taken the name “Thalibah” first... etc. So give us a ruling, O Shaykh, regarding the Hajj of this woman, and what the pilgrim should declare and what is required of him for her in the future or the present?

A : If the matter is as mentioned in the question, then the Hajj for “Thalibah” and “Halibah” is valid, and the forgetfulness of the one who performed Hajj for “Halibah” and making it in the name of “Thalibah” does not affect his Hajj for “Halibah”; because the consideration is the intention of the one who paid the money for “Halibah”;
due to the saying of the Prophet (peace and blessings be upon him):
The reward of deeds depends upon the intentions and every person will get the reward according to what he has intended.إنما الأعمال بالنيات وإنما لكل امرئ ما نوى
Sahih al-Bukhari 1
. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
