Collecting money in the name of the deceased and making the intention for him, and giving charity or carrying out a charitable project with it

Fatwa number ( 16399 )
Q: A young man from among the people of good and righteousness, and from the students of knowledge, who used to enjoin what is right and forbid what is wrong, passed away in our midst. This is what we believe of him, and we do not praise anyone before Allah. He had not yet married, and he was working as a teacher – may Allah have mercy on him. One of his colleagues decided to collect a sum of money from the Muslims to do a good deed in his name. He tells those who donate: “Mention so-and-so,” meaning: “Make the intention for so-and-so.” After collecting the money, he will build a mosque with it in the country of Somalia in the name of this deceased man, so that it will be considered ongoing charity for him. Some Muslims opposed him in this action, citing the fear of falling into shirk (associating partners with Allah) on the part of some Muslims there, due to their exaggeration in this matter and their holding of false beliefs about it, such as why a mosque is built for him and the like. The question is: Is it permissible to collect money in the name of the deceased and make the intention for him, and give charity or carry out a charitable project with it or not?
A : Donating money from the deceased’s relatives and friends, other than zakah, to be made ongoing charity for the deceased is among the prescribed acts of devotion. It is better not to write the name of the person for whom the mosque was built on the mosque, out of caution against exaggeration in his regard
and the fear of showing off. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
