The first question of Fatwa No. ( 20628 )
Q1: A man got married and took a sum of (40,000) from a person on the condition that he would pay (60,000), with (2,000) riyals each month. Is this considered riba? It is known that it is deferred and paid in monthly installments. If he finishes the installments up to the amount of (40,000), what should he do? Does he refuse the increase, or does he pay something else in exchange for the remaining amount? There is a document to that effect. .
A: The scenario described in the question is one of the forms of riba; because it is a loan with interest, and that is explicit riba. Allah the Exalted has forbidden riba and threatened those who engage in it with severe warning. The Messenger of Allah (peace and blessings be upon him) cursed: (the one who eats riba, the one who gives it, its two witnesses, and its scribe). The one who took this loan must give the owner of the right his right without any increase; so that he does not become an assistant to him in eating riba and a partner with him in the sin. He should advise the owner of the right to repent to Allah from eating riba, and not to return to such bad work, and to accept his principal without increase, and to fear his Lord Allah, so that he does not commit what Allah and His Messenger (peace and blessings be upon him) have forbidden. Allah the Exalted said:
But if you repent, you may have your principal - [thus] you do no wrong, nor are you wronged. (280) And if someone is in hardship, then [let there be] postponement until [a time of] ease.وَإِنْ تُبْتُمْ فَلَكُمْ رُءُوسُ أَمْوَالِكُمْ لاَ تَظْلِمُونَ وَلاَ تُظْلَمُونَ (279) وَإِنْ كَانَ ذُو عُسْرَةٍ فَنَظِرَةٌ إِلَى مَيْسَرَةٍ
[Al-Baqarah 2:279-280]
