Question: I borrowed one hundred pounds from a friend on the condition that I would repay him one hundred and fifty after one year, and when the time for repayment arrived, I tried to give him only one hundred, but he insisted on taking an additional fifty pounds in exchange for the delay. What is the ruling on this increase? And if this is a type of riba, is there a sin on me? How do I get rid of it? Answer: Allah, Glorified and Exalted is He, has forbidden riba and has made the warning against it severe,He said, (Glorified and Exalted is He):
Those who consume interest cannot stand [on the Day of Resurrection] except as one stands who is being beaten by Satan into insanityالَّذِينَ يَأْكُلُونَ الرِّبَا لَا يَقُومُونَ إِلَّا كَمَا يَقُومُ الَّذِي يَتَخَبَّطُهُ الشَّيْطَانُ مِنَ الْمَسِّ
[al-Baqarah: 275] ,until He, Glorified and Exalted is He, said:
(278) O you who have believed, fear Allah and give up what remains [due to you] of interest, if you should be believers. (279) And if you do not, then be informed of a war [against you] from Allah and His Messengerيَاأَيُّهَا الَّذِينَ آمَنُوا اتَّقُوا اللَّهَ وَذَرُوا مَا بَقِيَ مِنَ الرِّبَا إِنْ كُنْتُمْ مُؤْمِنِينَ فَإِنْ لَمْ تَفْعَلُوا فَأْذَنُوا بِحَرْبٍ مِنَ اللَّهِ وَرَسُولِهِ
[al-Baqarah: 278, 279] , and riba has forms and types, and one of its types is what you mentioned in this question, which is a loan with interest, because the lawful loan
is the good loan, by which you lend to your brother so that he benefits from the loan, and then he returns to you its equivalent without any agreed-upon increase or decrease. This is the good loan.
As for a loan that brings profit, or a loan intended to achieve a riba increase, this is forbidden by the Book, the Sunnah, and the consensus of the Muslims, and the severe warning applies to its doer. The obligatory thing is to return the equivalent of the amount you borrowed.
As for the increase he stipulated upon you and took from you, it is forbidden and riba. The Prophet (peace and blessings be upon him) cursed the one who eats riba, the one who gives it, its two witnesses, and its scribe. So he (peace and blessings be upon him) cursed the one who eats riba and the one who helped in eating it from among these people. So what you did is forbidden, and it is a major sin among the major sins. You must repent to Allah, Glorified and Exalted is He, and he must return to you this increase he took from you, because it is not lawful for him. You did a forbidden thing by giving him the increase, and it was obligatory for you to refrain from giving him the increase. If he insisted, you should refer his matter to the Muslim ruler to deter him from his crime. What you both engaged in is clear riba, so you all must repent to Allah, Glorified and Exalted is He, and not return to this transaction. The other party must return the increase he took. And Allah the Exalted knows best.
