The first question of Fatwa number ( 20756 )
Q1: A man bought a car for (30) thousand pounds and paid (25) thousand of its price, with (5) thousand remaining until a due date; that is, until one month. Then he sold this car for (35) thousand on a one-year credit. When the month arrived, he was unable to pay the five thousand, so he said to another man: "Pay (5) thousand for me and I will give you one-sixth of the profit and gain of the car that I sold." Is that permissible? Knowing that he entered into a guaranteed profit and sold his share before buying it. What is the ruling on this sale?
A1: The scenario described in the question is one of the forms of riba (usury or interest), and it is forbidden to deal in it; because its reality is that the one who pays this money to you is guaranteed that he will take more money from it, knowing the share mentioned and the sale of the car that you own on credit with a valid sale profit. However, it is not permissible for you to give the one who lent you five thousand more than what he gave you, and it is not permissible for the one who lent you to take that increase. It is obligatory for him to be scrupulous about consuming riba, and whoever leaves something for Allah, Allah will replace it with something better.
