Q29: If a person forgets a prayer, and then remembers it when the time for the second prayer has entered ; how does he make it up?
A29: It is obligatory for the Muslim to take care of the prayer and perform it in its time with the congregation, and not to be lazy about it or delay it; because this leads to its loss and forgetting. If he is overcome by forgetfulness or sleep and does not perform the prayer in its time, he must hasten to perform the prayer he forgot or slept through as soon as he wakes up or remembers it; based on what Muslim narrated, from Anas ibn Malik (may Allah be pleased with him), that the Prophet (peace and blessings be upon him) said:
He who forgets the prayer, or he slept (and it was omitted), its expiation is (only) that he should observe it when he remembers it.من نسي صلاة أو نام عنها فكفارتها أن يصليها إذا ذكرها

. So if a person wakes up or remembers and the time for the second prayer has entered, he must hasten to perform the missed prayer, then he prays the current prayer with the congregation. He does not pray the current prayer before the missed one; because the order is obligatory and necessary. If the current prayer is established before he makes up the missed prayer, he prays the missed one behind the imam in the current prayer. It does not harm him that his intention differs from the imam's intention, according to the correct opinion of the scholars, as long as that does not disrupt its order, like one who prays Maghrib behind one who is praying 'Isha' and has missed a rak'ah.
