Q317: The questioner says: What is the ruling on one who forgets the 'Isha' prayer and does not remember it until the time of the Fajr prayer? Please inform us about this, may Allah reward you?
A317: First, it is obligatory for the Muslim to take care of his prayer, performing it in its time with the congregation, and not to be lazy about it or delay it; because this leads to its loss or forgetting. As for what happens when a person is overcome by forgetfulness and does not perform the prayer in its time because of that, when he remembers, he must hasten to pray it at whatever time he remembers. He must hasten to pray the prayer he forgot or slept through; because of his saying (peace and blessings be upon him):
Whoever forgets a prayer or sleeps through it, let him pray it when he remembers it. There is no expiation for it except that.من نسي صلاة أو نام عنها، فليصلها إذا ذكرها، لا كفارة لها إلا ذلك
Sunan ad-Darimi 2:45
And Allah the Exalted said:
Indeed, I am Allah. There is no deity except Me, so worship Me and establish prayer for My remembrance.إِنَّنِي أَنَا اللَّهُ لاَ إِلَهَ إِلاَّ أَنَا فَاعْبُدْنِي وَأَقِمِ الصَّلاَةَ لِذِكْرِي
[Taha 20:14]
So, when a person remembers, he hastens to pray the missed prayer at whatever time that occurs for him. He prays the 'Isha' prayer first, then prays the Fajr prayer after it. He prays the missed prayer first, then prays the current prayer, and he does not pray the current prayer before the missed one, for the order is obligatory and necessary.
