Fatwa number ( 20817 )
Q: My father purchased a plot of land about twenty years ago, and it has no title deed, and he did not offer it for sale at any office. My father has passed away, and I took charge of it and had a title deed issued for it two years ago. I sold the land for the sum of (45,000), and I want to pay zakah. I know that when he died, the heirs offered all the deceased's property for sale. Do I pay zakah from the time the title deed was issued, or how do I pay zakah?
A: Since you do not know your father's intention regarding the aforementioned land, there is no zakah on it during his lifetime. As for after his death, it devolved upon his heirs. Since it was sold for the aforementioned amount, each person pays zakah on his share of this amount if a lunar year has passed while it is in his possession. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
