Q: A man has agricultural land, and a farmer farms it on a half of what comes out of it. The share of each of them—that is, the share of the landowner and the farmer—reached five wasqs or more. Zakah is due on them according to their share. This is what I know, and praise be to Allah. But what is required from your Eminence is: Does the landowner pay one-tenth of his share or half of one-tenth? Knowing that all the costs of farming, such as wages for workers, plowing, sowing, watering, the price of fertilizer, and so on, are on the farmer. As for the owner of the land, he usually takes his share without contributing to the farming expenses. What is the ruling if the landowner contributes with the farmer in the necessary expenses? And in the case where the farmer bears all the farming costs alone, does he pay zakah on his share as one-tenth or half of one-tenth according to the cost, after deducting the expenses, or does he pay it
from all the grains obtained by him? Likewise, if the landowner farms his land himself, does he pay zakah after deducting the expenses, or how does he do it?

A: Zakah is obligatory on the owner of the land and on the farmer, each in his share, if it reaches five wasqs, and each of them pays half of one-tenth; because the crops are watered with effort, even if the costs and farming expenses are on the farmer.
