What is the ruling on a farmer who has surplus wheat and enters it under the name of another person while he receives the price?

The Shaykh : And upon you be peace and the mercy of Allah.

The Shaykh : What is your opinion regarding some farmers who have wheat in excess of their allotted amount? For example, his allotment is one hundred tons, but he has one hundred and fifty tons. He enters these fifty tons under the name of another person.

The Shaykh : Is he a farmer or not?

The questioner : He is a farmer, but he has a surplus according to the certificate.

The Shaykh : Yes, that is correct.

The questioner : So after receiving the amount, does he hand over the value of this harvest to its owner?

The Shaykh : Does that mean he puts the extra fifty tons under the name of another farmer?

The questioner : Yes, that is correct.

The Shaykh : Will the other farmer add the fifty tons to his own crop?

The questioner : To his crop, and after receiving the amount, he hands over the owner's right.

The Shaykh : By Allah, it appears that it is not permissible. However, if he sells it to him, there is no harm. In such a case, it is better to sell it to him so that it is truly and legally entered under the name of the second farmer. As it stands, if it is entered under the name of the second farmer while it belongs to the first, there is lying involved. Therefore, the best course in such a situation is to say to the one who has this surplus: Sell it to this man. Sell it to him, whether you wish for cash or deferred payment.
