Q: I am the representative of the Al-Zubnah Al-Hayyan tribe. When I collected the tenth from the third worker, Tihama Qahthan , they gave me sheep. Among these sheep were some that belonged to me, which I had paid to them as zakah on my sheep. Is it permissible for me to take my sheep, which I had paid as zakah, from within my tenth on the zakah?
A: If sheep that you had paid as zakah to their owner come to you within the tenth allocated to you, it is not permissible for you to take them; due to the prohibition of the Prophet (peace and blessings be upon him) of 'Umar from returning to the horse he had given in charity, and he said to him:
Do not buy it, even if he gives it to you for a dirham.لا تشتره ولو أعطاكه بدرهم
If this is the case regarding what is taken in exchange, then it is even more so regarding what is taken without exchange.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
