Q38: How can a soldier participating in a Hajj mission perform Hajj while carrying out his duties in a way that does not interfere with his work, if his work requires his stable presence in Mina or in 'Arafah or elsewhere? And does he commit a sin by leaving some of the obligatory acts or by doing some of the prohibited things, such as wearing sewn clothing and a head covering, or by not staying overnight in Mina or Muzdalifah, or otherwise?
A38: As for the soldiers who participate in Hajj missions and wish to perform Hajj, if it is with the permission of their authority and does not result in neglecting their duty, then it is permissible. They must perform the acts of Hajj, including standing at 'Arafah until the sun sets. If that is not possible until after sunset due to work, they may stand there at night, even if only by passing through it. Likewise, staying overnight in Muzdalifah is required, and they may leave after midnight if their work requires it. Staying overnight in Mina is obligatory, unless their work is outside of it during the time of staying overnight; in that case, it is dropped from them and they are excused for it, and they owe nothing. As for clothing, they do not commit a sin by wearing military uniforms if their work requires it. It is obligatory for them to offer a sacrifice by slaughtering a sheep in the Haram and distributing it to the poor of the Haram , or to feed six poor people from the poor of the Haram, giving each poor person half a sa' of food, or to fast for three days in any place.
