Q: I have a daughter who is over forty years old. She has been deaf and mute since birth, and we were unable to teach her because we were in Tihamah and did not have knowledge of how to teach her. She performs her other acts of worship by imitating her mother and sisters, such as prayer; she performs wudu' and prays, but without recitation, dhikr, or intention, because she knows nothing about them; her affairs are based on imitation. The question, O Shaykh: Should I perform Hajj on her behalf because she does not know the intention, or should she perform it herself and the intention of her guardian be sufficient?
A: It is obligatory for the woman mentioned to perform Hajj if its conditions are met for her, because she is of sound mind and does what people do in the rituals, and her guardian explains to her by gesture what she is able to understand; for Allah the Exalted said:
So fear Allah as much as you are ableفَاتَّقُوا اللَّهَ مَا اسْتَطَعْتُمْ
[At-Taghabun 64:16]
