Q6: I have owned an apartment for several months. I decided to sell it, then I changed my mind when no one offered the price I wanted, so I decided to keep it so that one of my sons could get married in it. Then I decided to sell it again, and so on. My decision fluctuates between selling it and keeping it, without any intention to deprive the poor of their rights. What is the ruling?
A6: As long as you have offered the apartment for sale with the intention that if someone offers you a good price, you will sell it, then this apartment is considered trade goods. When a lunar year has passed over it, you appraise it at its current market price and pay its zakah, which is one-quarter of one-tenth. This is the reality of trade: a person intends to sell his goods if a suitable price is offered to him. However, if your intention settles on keeping it for the purpose of residence or rental, then there is no zakah on the apartment itself, but rather zakah is due on the rental income if it reaches the nisab (minimum threshold for zakah) and a lunar year has passed over it; you then pay one-quarter of one-tenth of it.
