Praise be to Allah alone, and may peace and blessings be upon the one after whom there is no prophet. After that: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Grand Mufti from His Excellency: the Acting Director General of the Religious Affairs Department of the Armed Forces, Shaykh Abdullah ibn Saleh ibn Abdul Hamid Al-Shaykh , under number (2/10/1985) and dated 25/6/1425 AH, and referred to the Committee by the General Secretariat of the Council of Senior Scholars under number (4456) and dated 8/7/1425 AH. His Excellency requested the Committee to look into the graves located within the building of the command camp in the
Madinah al-Munawwarah region. These are old graves whose owners are unknown, and there is a desire to look into the possibility of transferring them to the nearest public cemetery, as His Excellency the Commander of the Madinah al-Munawwarah region has expressed the intention to utilize the land after their transfer, given the public interest.
After studying the inquiry, the Committee issued a ruling that it is obligatory to respect the deceased Muslims buried in the aforementioned cemetery by preserving and maintaining it, and not subjecting it to any form of encroachment, such as digging up or cutting off a part of its land. Since it has been established that it is an old cemetery, it is the right of the deceased Muslims buried there, and the sanctity of a Muslim in death is like his sanctity in life.
