The fifth question of the fatwa number ( 17941 )
Q 5: The Muslims here, and because they lived with the Russians, the general public among them do not pray; some of them who have reached the age of seventy do pray. If one of the Arabs here dies, should he be buried in the graves of these people, or should he be transferred to his Muslim country?
A 5: One who dies while not praying is not considered a Muslim, and he is not to be buried in the graves of the Muslims; because the Prophet (peace and blessings be upon him) said:Sunan Ibn Majah 1078Sahih (Darussalam) narrated by Muslim . As for one who dies while testifying that there is no god but Allah and that Muhammad is the Messenger of Allah, and he preserves the prayer, and nothing has occurred from him that contradicts Islam, then it is not permissible for him to be buried in the graves of the disbelievers; rather, he is to be buried with the Muslims in his country, or he is to be transferred to the graves of the Muslims in the nearest place.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
