Q: I have a son who was seventeen years old. He passed away two months ago in a car accident, and he bore no sin in it. My son did not pray and did not fast the month of Ramadan. Is it permissible for me, his mother, and his brothers to make up the month of Ramadan on his behalf? And will he be rewarded if I fast on his behalf on the Day of Ashura or on the Day of
'Arafah, or on Mondays and Thursdays? I also pray four rak'ahs for him before the midday prayer, two after it, and two after the afternoon, sunset, night, and dawn prayers.

A: If a person dies while not praying and not fasting, he is not considered a Muslim; because one who deliberately abandons prayer is a disbeliever; due to the saying of the Prophet (peace and blessings be upon him):
Between the servant and disbelief and shirk (associating partners with Allah) is the abandonment of prayerبين العبد وبين الكفر والشرك ترك الصلاة
, so if he dies in this state and does not repent to Allah (Mighty and Majestic), it is not permissible to seek forgiveness for him or to make supplication for him. As for the prayers you perform on his behalf, they do not benefit him, even if he were a Muslim; because prayer does not admit of representation, and after the afternoon prayer, voluntary prayer is not prescribed except for a reason. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
