A: One who dies among those of legal age while not praying is a disbeliever. He is not washed, no prayer is performed over him, he is not buried in the graves of Muslims, and his relatives do not inherit from him; rather, his wealth belongs to the treasury of the Muslims according to the most correct opinion of the scholars. This is based on the saying of the Prophet (peace and blessings be upon him) in the authentic hadith:Sahih Muslim 82b It was narrated by Imam Muslim in his Sahih. And based on his (peace and blessings be upon him) saying: Sunan Ibn Majah 1079Sahih (Darussalam) It was narrated by Imam Ahmad and the people of the Sunan with a sound chain, from the hadith of Buraydah (may Allah be pleased with him).
