Q: What is the ruling in Islam regarding a group of emigrants from the lands of Islam
to the lands of disbelief who collect funds monthly or annually for the purpose of sending the body of any member of the group from the land of disbelief to their Islamic homeland, and no portion is returned to any member of the group who does not die there? The reason for sending the bodies is that graves in these Western countries are insured for large sums of money that no individual emigrant can afford, and even if it were paid, the grave is dug up when the insurance period ends, and the bones inside are burned. Is it permissible to join such a group, and is zakat obligatory on this money?
A 2 : There is no harm in collecting funds for the purpose of spending on the transfer of the bodies of deceased Muslims to bury them in a suitable place; because transferring them in the mentioned situation is necessary, and there is no zakat on the funds collected for this purpose; because these funds do not have a specific owner, and because they are in the way of righteousness. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
