Q: We present to you the topic of the deceased in the hospitals of Makkah al-Mukarramah, and perhaps other related entities such as traffic, police, or the municipality, which wash the deceased. It is observed that the deceased in ihram, whether male or female, is handled by all the aforementioned entities, including the hospitals, which cover the face and head of the deceased in ihram . We desire a written fatwa on how to handle these cases, taking into consideration the following: 1- If the body is burned, especially the face and head. 2- If the face or head is disfigured as a result of an accident. 3- If the face of the deceased woman is beautiful. 4- If it is necessary to preserve the body in a refrigerator.
A: The Sunnah is that if a person in the state of ihram dies, he is washed with water and sidr and the like, and no perfume is applied to him, whether male or female, and nothing is taken from their hair or nails. The man does not wear sewn clothing, and his head and face are not covered. If there are non-mahram men present with the woman in the state of ihram, her face is covered; for it is established from Ibn Abbas (may Allah be pleased with them both) that the Prophet (peace and blessings be upon him) said regarding the person in the state of ihram who was gored by his camel while standing at 'Arafah :
Wash him with water and sidr, shroud him in his two garments, do not embalm him, do not apply perfume to him, do not cover his head or his face, for he will be resurrected on the Day of Resurrection while reciting the talbiyah.اغسلوه بماء وسدر وكفنوه في ثوبيه، ولا تحنطوه ولا تقربوه طيبًا ولا تخمروا رأسه ولا وجهه، فإنه يبعث يوم القيامة ملبيًّا
As for the woman, her head and face are covered like the rest of her body; because the prohibition for the woman in the state of ihram is specifically regarding the niqab (face veil), whereas covering her face with something other than the niqab is commanded when a non-mahram is present. As for if the body is burned, then tayammum is performed for it, and likewise if washing the face is difficult, tayammum is performed for the deceased. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
