Fatwa No. ( 21000 )
Nine years ago, my wife was five months pregnant. She experienced bleeding that continued until the end of the sixth month. She was hospitalized from the start of the bleeding. In the sixth month, she delivered a male fetus, which was dead. My wife told them: “Hand it over to its father so he can bury it.” They said: “We will hand it over during visiting hours.” When visiting time came, my wife asked them about it, and they said: “We have sent it to the Asir hospital laboratory to investigate the causes of the bleeding.” After they informed my wife of this, I did not look for it, and I do not know what happened to that child from that time until now. I ask you, may Allah reward you, to issue a ruling for me.
A: If a fetus is delivered after four months have been completed, it is obligatory to wash it, shroud it, pray over it, and bury it in the cemetery like other deceased persons. It is recommended to name it and offer a sacrifice on its behalf. What this man did by leaving the delivered fetus
that was delivered from his wife, having reached the age mentioned, is undoubtedly a great error and negligence for which he will be held accountable. He must repent to Allah and ask the hospital what was done regarding this fetus at that time, in order to clear his conscience. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
