Q 1: Several of my father’s children of different ages passed away, ranging in age from two to five years old. Some died during birth, and two were miscarriages in the fourth and fifth months. They were buried, but the funeral prayer was not performed for them due to his ignorance of the ruling. Is my father required to do anything? May Allah preserve you.
A 1 : The soul is breathed into the fetus after one hundred and twenty days from the beginning of pregnancy. If the child is delivered before the soul is breathed into it, it is not washed, and no funeral prayer is performed for it. If it is delivered after the soul has been breathed into it, it is given a name, washed, shrouded, the funeral prayer is performed for it, and it is buried in the Muslim cemeteries, provided it is from Muslim parents, or its father is Muslim and its mother is from the People of the Book. An ‘aqiqah sacrifice is performed for it if it is a male, with two sheep, each of which is sufficient as an ‘Id sacrifice. If it is a female, the ‘aqiqah is one sheep. The Sunnah regarding the ‘aqiqah is to eat one-third, give one-third as a gift, and give one-third in charity to the poor. It is slaughtered on the seventh day of its birth or delivery, or on the fourteenth day, or the twenty-first day, and then on any day thereafter. Based on the foregoing, there is no sin on your father regarding those in whom the soul was not breathed. He must repent for what occurred from him, namely leaving those in whom the soul was breathed without washing, shrouding, or performing the funeral prayer for them. It is recommended for him to give a name to each of those in whom the soul was breathed, whether male or female, and to perform the ‘aqiqah for them as previously explained.
