Q1: My father (may Allah have mercy on him) passed away, leaving behind a male child who was five months old. It has been 18 years since his death. My father (may Allah have mercy on him) refused to perform the 'Aqiqah (sacrifice) for him, because he used to say that a child like this does not have an 'Aqiqah. In other words, the reason for his refusal was his ignorance. We want your Eminence to inform us of what is obligatory for us regarding this matter, and may Allah reward you with the best reward.
A1: The 'Aqiqah is a confirmed recommended practice (sunnah) for the father when a child is born to him, even if the father has died, and even for a fetus if it is aborted after the soul has been breathed into it, and the duration for this is four months; because it is a soul into which the spirit has been breathed; and it will be resurrected on the Day of Resurrection, so the 'Aqiqah was prescribed for it; due to the generality of the saying of the Prophet (peace and blessings be upon him):Sunan Ibn Majah 3164Sahih (Darussalam) It was narrated by Imam Ahmad and al-Bukhari and the authors of the Sunan. From Salman ibn Amir , and due to the generality of the saying of the Prophet (peace and blessings be upon him): Sunan Abi Dawud 2837 , and in a narration: Sunan Ibn Majah 3165Hasan (Darussalam) It was narrated by Imam Ahmad and the authors of the Sunan, and al-Tirmidhi deemed it authentic . If the father refuses to perform the 'Aqiqah for his child, or if the father dies before performing it for him, it is recommended (sunnah) for one of his relatives, such as his brothers, mother, uncles, or the like, to perform the 'Aqiqah for him. For a boy, two sheep are sacrificed, and for a girl, one sheep. He will have the reward and recompense from Allah for that. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
