Q: A group for memorizing the Qur'an for women provides transport for the sisters who work permanently at the Qur'an memorization school, and for the students occasionally. We face a problem and we want to know the ruling of the Shari'ah regarding it. It is that when the driver of the transport brings the sisters from their homes to the school, the 'Asr prayer occurs during that time, and consequently the driver is forced to be absent from attending the 'Asr prayer in congregation at the mosque . We know that we cannot delay their arrival so that the driver starts passing by them after the 'Asr prayer, because this would lead to them missing their Qur'an lessons. Also, they cannot arrive at the school before the 'Asr prayer, because this would require them to leave their homes early, knowing that some of them are students and employees during the morning period and do not return to their homes until late in the afternoon. Some are housewives with multiple responsibilities, and it is difficult for them to leave long before the school (Qur'an memorization) starts. Also, the driver of the transport cannot stop on the road to perform the 'Asr prayer
in congregation and then continue the journey, because this would lead to them being late for the school and missing their Qur'an lessons, and the Qur'an memorization group would be harmed in addition to the students, due to the delay of the teachers who give the Qur'an lessons. We want to clarify to Your Eminence that the homes of these sisters are far from the school, and it requires a considerable amount of time to gather them and take them to the school, where the start of the session is approximately 45 minutes after the 'Asr adhan. What is the ruling of the Shari'ah regarding the driver's absence from the 'Asr prayer in congregation at the mosque, and do we bear any sin for that? Knowing that we are the ones responsible for directing the transport. Please issue a ruling, may Allah reward you.

A: It is obligatory to enable the driver to pray in congregation at the mosque, even if it means delaying the start of the lessons to correspond to that, because congregational prayer is obligatory for men in the mosques, and what you mentioned is not an excuse for leaving it. May Allah guide you and help everyone with all good. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
